  • In order for criminal liability for joint criminal enterprise to arise, the following conditions must be present: (a) a plurality of persons; (b) the existence of a common plan involving the commission of an international crime (the need for, design of or purpose of the plan need not be previously arranged or formulated, but “may materialize extemporaneously and be inferred from the fact that a plurality of persons acts in unison to put into effect a joint criminal enterprise”); and (c) participation of the accused persons in the execution of the common plan.
